1. Who we are
Desi Closet is an independent UK-based sole trader operating an online marketplace at desicloset.co.uk. You can reach us at support@desicloset.co.uk. In these terms "we", "us" and "our" refer to the operator of Desi Closet.
We operate an online marketplace at desicloset.co.uk where users may buy and sell pre-loved South Asian clothing. We are not party to the contract of sale — sellers are independent third parties.
2. Accounts
You must be at least 18 to use Desi Closet, give accurate information, keep your password private, and verify your email before listing or buying. You are responsible for activity on your account. We may suspend accounts that breach these terms.
3. Listings & prohibited items
Sellers warrant that listed items are theirs to sell, accurately described, legal to sell in the UK, and not counterfeit. The following are prohibited:
- Counterfeit or replica goods, or items that infringe intellectual property
- Stolen goods or items obtained unlawfully
- Weapons, knives, ammunition, or any age-restricted item
- Drugs, drug paraphernalia, or unregulated medical devices
- Items subject to UK import or export restrictions
- Hate symbols, indecent images, or anything otherwise unlawful
We may remove listings and suspend sellers at our discretion. Removal by an administrator is logged with a reason which the seller will be shown.
Sellers are solely responsible for declaring earnings from Desi Closet to HMRC and any other tax authority. We do not withhold tax on sellers' behalf.
4. Buying & payments
Payments are processed by Stripe. Funds are held by Desi Closet in escrow and released to the seller once the buyer confirms delivery, or 5 days after shipping (whichever comes first), unless a dispute is raised. Buyers may cancel an order and receive a full refund at any time before the seller marks the item as shipped.
5. Platform fee
Desi Closet charges sellers an 8% commission on each completed sale. Buyers pay no fee beyond the item price. The fee is shown on the seller's earnings page.
6. Disputes
Buyers may report a problem within 5 days of an item being marked shipped, with a written reason (at least 10 characters) and at least one photo. We review each dispute within 5 business days during our beta period (target: 3 business days at scale) and may refund the buyer fully or partially. See our Refund Policy.
7. Complaints
To complain about anything on the platform, email support@desicloset.co.uk with the subject "Complaint". We will acknowledge within 5 business days and respond substantively within 28 days.
8. Liability
To the maximum extent permitted by law, our liability for losses arising from third-party seller conduct, missed deliveries, or item condition outside our escrow and dispute process is limited to the amount the buyer paid through the platform for the affected item. Nothing in these terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under UK law.
Your statutory rights as a UK consumer are not affected by these terms. Where the seller acts as a business (a "trader"), you continue to enjoy protection under the Consumer Rights Act 2015 and a 14-day cooling-off right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
9. Changes
We may update these terms. Material changes will be notified by email or an in-app banner at least 14 days before they take effect. Continued use after changes means you accept them. The latest version is always at desicloset.co.uk/legal/terms.
10. Governing law
These terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
